|Technical Regulations - document (legal act), which establishes mandatory application and enforcement requirements for objects of technical regulation (products, including buildings, structures and facilities, processes of production, operation, storage, transportation, sale and disposal), in contrast to ISO, GOST, TU and other standards with voluntary use. The concepts of "Rules" and "Technical Regulations" in Russia for the first time, changes were N 2 (1996) in the GOST R 1.0-92. According to these definitions Regulations - a document containing the required legal standards and accepted by the authorities. Technical Regulations - regulations establishing specifications of products (services) or related processes and production methods. It may also include requirements for terminology, symbols, packaging, marking or labeling, or be devoted entirely to these issues.
In connection with the decision of the Commission of the Customs Union № 823 from 18.10.2011g. adopted technical regulations of the Customs Union "On the safety of machinery and equipment", which will come into force on 15 February 2013.
1. The list of standards as a result of which, on a voluntary basis, compliance with the technical regulations of the Customs Union "On the safety of machinery and equipment."
2. The list of standards containing rules and methods (tests) and measurements, including the rules of sampling necessary for the application and enforcement of the technical regulations of the Customs Union "On the security of machinery and equipment" and the implementation of assessment (confirmation) of product conformity.
Technical regulation is designed to establish a single customs territory of the Customs Union, a mandatory for the application and enforcement of the requirements for the machines and (or) equipment in the development (design), manufacturing, installation, commissioning, operation, storage, transportation, marketing and utilization, providing free moving machines and (or) equipment put into circulation in the common customs territory of the Customs Union.
Currently operates only Russian technical regulations "On the safety of machinery and equipment", and since February 2013 it is no longer required and all of the requirements for conformity assessment of products will be confirmed in accordance with the requirements of the Technical Regulations of the Customs Union "On the safety of machines and equipment"
All issued certificates of conformity by the technical rules of the entry into force of the decision ( from October 2011), regardless of the fact that the certificate of conformity has been issued for a period of five years, no matter that it will be in effect until March 15, 2015 - this limitation prescribed in Section 3.2 Decisions № 823.
Resolved before that time turnover and the production of goods and products that match the quality and supported by documents obtained under the previously existing legal acts of the Customs Union, or the legislation of the Customs Union. Such goods must necessarily be marked in accordance with legal and regulatory requirements of the legislation of the country where they were produced, or manufactured, that is, must comply with the national conformity.
From the date of entry into force of the Technical Regulations of the Customs Union binding document confirming the conformity of products will be the certificate of compliance with the technical regulations of the Customs Union.
